Who these terms are between
This website is operated by Afiyatech Commercial Company, a company registered in the Kingdom of Saudi Arabia under commercial registration CR 101088142, VAT registration 313050062700003, with its address at Zaid Ibn Thabit, Al Malaz District, Riyadh, Saudi Arabia. In these terms, “Afiyatech”, “we” and “us” mean that company; “you” means the person using the site and, where you are acting for an organisation, that organisation as well.
By using this website you accept these terms. If you do not accept them, please do not use the site. If you are using it on behalf of a hospital, laboratory, manufacturer or other organisation, you confirm that you are authorised to accept these terms on its behalf.
These terms govern the website. They do not replace any supply agreement, framework agreement, tender award or purchase order terms in force between Afiyatech and your organisation. Where those conflict with these terms in relation to a supply of goods, those terms prevail.
What this website is
This site is an information and enquiry resource for laboratory, hospital and manufacturer professionals. It describes the categories Afiyatech distributes, lists the products in our catalogue, and provides two forms — one to request a quotation, one for manufacturers proposing a Saudi market-entry partnership.
It is not a shop. There is no checkout, no payment is taken, and no order can be placed through it. Adding an item to the enquiry list is a note to yourself; it commits neither side to anything.
The site is aimed at the Saudi market and is published in English. Nothing on it is an offer or solicitation in any jurisdiction where that would be unlawful.
Enquiries, quotations and orders
- Nothing on this website is an offer capable of acceptance. Catalogue entries, category descriptions and any figures shown are an invitation to enquire.
- Submitting a form creates no contract. It asks us to prepare a response. We may decline any enquiry, and we are not obliged to give a reason.
- A quotation is the operative document. Where we issue a written quotation, that quotation — with its stated prices, quantities, pack sizes, validity period and delivery terms — governs, and it prevails over anything shown on this website.
- A contract of supply forms only when we accept your purchase order in writing, or when a signed agreement or tender award says it does.
- Accuracy is your side of it. When you submit an enquiry you confirm that the information in it is accurate, that you are authorised to submit it, and that you have not included patient data or any other person's personal data without a lawful basis for doing so.
- Reference numbers. The
AFY-reference generated when you submit a form identifies the enquiry. It is not an order number and it confirms nothing about availability, price or acceptance.
Product, regulatory and clinical information
This is the section that matters most. Please read it in full.
4.1 Confirm before you rely on it
Product availability, SFDA regulatory status, instructions for use, assay compatibility, pack configuration, pricing and delivery terms must be confirmed with us in writing before quotation or clinical use. Catalogue entries are prepared from manufacturer documentation and public regulatory guidance and are kept as current as we can, but regulatory status and product specifications change, and a page on a website is not a regulatory record.
4.2 The IFU governs
The manufacturer's instructions for use, package insert and labelling govern the use of every product we supply. Where anything on this website differs from the current IFU, the IFU prevails. Descriptions here are summaries written for procurement, not clinical instructions.
4.3 No medical advice and no equivalence claims
This website does not provide clinical, diagnostic or laboratory advice, and nothing on it should be used to make a clinical decision. It makes no claim that any product is equivalent to, interchangeable with, or a substitute for any other product. Assessing suitability, validating a method and confirming compatibility with your analysers and workflows remain the responsibility of the qualified professionals in your laboratory.
4.4 Registration is per product and per moment
SFDA registration, MDMA status and authorised-representative arrangements apply to a specific product, in a specific configuration, at a specific time. A category being listed here does not mean every item in it is currently registered or currently importable. We will confirm the position for the specific items you ask about.
4.5 No substitution without your approval
Afiyatech will not substitute a product for another without the buyer's explicit approval. Where a substitution is proposed, it is put to you in writing with the reason and the alternative identified, so that your laboratory can make the compatibility and IFU assessment itself.
4.6 Accreditation marks
Where SFDA, NUPCO, CBAHI, JCI or CAP marks appear on this site, they identify the regulator, the procurement channel or the accreditation frameworks that our clients are audited against. They do not indicate that Afiyatech holds those accreditations, and they must not be read as an endorsement of Afiyatech by those bodies.
Preanalytical error: up to 75% of laboratory errors originate in the preanalytical phase. The right tube, the right medium and the right container are not interchangeable. Ask us to confirm the specification — we would far rather answer the question than have it assumed.
Availability, lead times and pricing
- Availability bands are indicative. Where the catalogue shows a stock position or a lead-time band, it describes our normal expectation for that line, not a commitment for your order. Stock is confirmed at the point of quotation.
- Lead times depend on the supply chain. Manufacturer allocation, shipping, customs clearance and SFDA import formalities all affect delivery, and some are outside our control.
- No prices are published on this site. Pricing is given by written quotation, is valid for the period the quotation states, and is quoted in Saudi Riyals unless the quotation says otherwise. Any applicable VAT is stated separately.
- Cold-chain products carry storage and transport conditions that form part of the specification. Where a product requires 2–8 °C or −20 °C handling, that is a condition of supply and of your acceptance on delivery, not an optional extra.
Intellectual property and third-party marks
Our material. The design, layout, text, structure, photographs and code of this website are owned by Afiyatech or licensed to it, and are protected by Saudi and international intellectual property law. You may view the site, and print or download extracts for your own internal procurement, evaluation or audit purposes. You may not otherwise copy, republish, adapt or commercially exploit any part of it without our written permission.
Manufacturer marks. Product names, trade marks, logos and product photography belonging to Copan, bioMérieux, Kibion, Roche, Sysmex, CTK Biotech, BD, Anios, GV Health, BioBase, DLAB, Goldsite and every other manufacturer named on this site are the property of their respective owners. They appear here to identify the goods we distribute. Their presence does not imply that the owner endorses Afiyatech, beyond any distribution appointment we hold and state expressly.
Regulator and accreditation marks are the property of the bodies concerned and are used descriptively, as set out in section 4.6.
If you own a mark used here and want its use changed or removed, write to contact@afiyatech.com and we will deal with it promptly.
Acceptable use of this website
You agree not to:
- Systematically extract, scrape, mirror or reproduce the catalogue or any substantial part of it, whether by automated means or otherwise, or use it to build a competing product list or database.
- Submit false, misleading or impersonating information through either form, or submit an enquiry on behalf of an organisation without its authority.
- Submit patient data, personal data of third parties without a lawful basis, or any confidential information you are not entitled to disclose.
- Introduce malicious code, attempt to gain unauthorised access to the site or its hosting, or interfere with its availability for others.
- Use the site or anything on it in a way that breaches any applicable law, or that misrepresents a regulatory or accreditation position.
We may restrict or withdraw access where we reasonably believe any of the above is happening.
Disclaimers and limits on liability
We take reasonable care to keep the information on this website accurate and current, and to keep the site available. We do not, however, warrant that the site will be uninterrupted or error-free, or that catalogue content is complete, current or free from omission. Content is provided for information.
To the fullest extent permitted by the laws of the Kingdom of Saudi Arabia, Afiyatech is not liable for:
- loss or damage arising from reliance on website content that has not been confirmed by us in writing, as required by section 4;
- indirect or consequential loss, loss of profit, loss of contracts, loss of anticipated savings, or loss of business opportunity;
- unavailability of the site, or loss of data held in your own browser's local storage;
- the content, availability or practices of any third-party website or service linked from here.
Where Afiyatech is liable in connection with your use of this website, that liability is limited to the value of the order to which the claim relates, or, where there is no such order, to the amount of any direct loss actually and reasonably incurred.
Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot be excluded or limited under the laws of the Kingdom of Saudi Arabia. Liability for products supplied is governed by the applicable supply agreement, by Saudi medical device regulation and by the manufacturer's own responsibilities — not by this website.
Sanctions, export control and anti-bribery
Sanctions and export control. Products we distribute may be subject to export control or sanctions rules in their country of origin as well as in the Kingdom. Afiyatech will not supply, and you may not seek to procure through us, any product in breach of applicable sanctions or export control law. We may decline or halt any transaction on that basis, at any point.
Anti-bribery. Afiyatech does not offer, give, solicit or accept any improper payment, gift or advantage in connection with the award of business, and expects the same of everyone who deals with us. This applies without qualification to public tenders, NUPCO procurement and hospital purchasing decisions. If anyone acting for Afiyatech suggests otherwise, report it to contact@afiyatech.com and it will be investigated.
Third-party links and services
This site links to manufacturer pages, regulatory guidance, mapping services and other external resources. Those links are provided for convenience. We do not control those sites, we are not responsible for their content or their privacy practices, and a link is not an endorsement.
The site relies on a small number of third-party services to function — web font delivery and form delivery among them. Which services, what they receive and where they operate is set out in the privacy policy and the cookies and local storage notice.
Changes to the site and to these terms
We may change, suspend or withdraw any part of this website, including catalogue content, at any time and without notice. Catalogue entries are maintained on a best-efforts basis and may be added, amended or removed as our range and its regulatory status change.
We may also amend these terms. The version and effective date at the top of this page always reflect the current text, and the version that applied at the time you used the site is the version that governs that use. Continuing to use the site after a change means you accept the amended terms.
Governing law, jurisdiction and language
These terms, and any dispute or claim arising out of or in connection with them or with your use of this website, are governed by the laws of the Kingdom of Saudi Arabia.
The competent courts of Riyadh have jurisdiction, save where a supply agreement between Afiyatech and your organisation provides for a different forum or for arbitration, in which case that agreement governs disputes arising under it.
These terms are published in English. If they are translated into Arabic and the two versions differ, the Arabic version prevails for the purposes of Saudi law and before the Saudi courts.
If any provision of these terms is held invalid or unenforceable, the remaining provisions continue in force.
